杨良宜,男,1948年出生于上海,5岁时移居香港。现任香港国际仲裁中心主席,海事、商事仲裁员,香港海商及国际贸易高级顾问;北京大学、中国政法大学、大连海事大学及香港城市理工大学等二十余所著名大学的客座教授。 杨良宜教授还担任英国特许仲裁员学会(Chartered Institute of Arbitrators)高级会员(FCIArb.),英国特许船舶经纪学会(Institute of Chartered Shipbrokers)高级会员(FICS),英国特许保险学会(Chartered Institute of Insurance)会员(ACII)。 杨良宜教授具有深厚的理论功底。他著述丰富,主要著作有:《提单》、《外贸及海运诈骗》、《滞期费》、《英国海上保险条款详论》、《期租合约》、《程租合约》、《国际商务仲裁》、《国际商务游戏规则——英国合约法》、《造船合约》、《信用证》、《国际货物买卖》、《禁令》及《海事法》等等。 同时,杨良宜教授还具有丰富的实践经验,他从事国际航运及国际贸易业务超过三十年,熟悉香港、亚洲地区及国际贸易等实物,作出过仲裁裁决书超过二百份。 多年来,杨良宜教授一直致力于海商法、国际贸易等知识的普及工作,先后在国内外50多所知名大学进行过上百场演讲,在国内的清华大学、北京大学、中国政法大学、中山大学等高校都受到了广泛的好评,讲演后师生都被他的渊博学识所折服,为他的人格魅力所倾倒。 值得一提的是,今年9月5日在北京召开的第二十二届世界法律大会上,杨良宜教授应邀作了专题发言。杨良宜教授介绍了香港仲裁条例正在进行的将香港本地仲裁和国际仲裁结合在一起的改革,以及将英国1996年仲裁法的一些有用条款纳入仲裁条例的意向。说明香港国际仲裁中心最具重要的两大职能是作为仲裁员的指定机构以及决定国际仲裁案件的仲裁庭组成。
5. Liability of BUILDER: The Representative and his assistant (s) shall at all times bedeemed to be the employees of the BUYER and not of the BUILDER.The BUILDER shall be under no liability whatsoever to the BUYER,the Representative or his assistant(s) for personal injuries, includingdeath, suffered during the time when he or they are on the VESSEL.or within the premises of either the BUILDER of its subcontractors,or are otherwise engaged in and about the construction of theVESSEL, unless, however, such personal injuries, including death,were caused by a gross negligence of the BUILDER. or of any of itsemployees or agents or subcontractors. Nor shall the BUILDER beunder any liability whatsoever to the BUYER, the Representative orhis assistant (s) for damage to, or loss or destruction of property inJapan of the BUYER or of the Representative or his assistant (s),unless such damage, loss or destruction were caused by a grossnegligence of the BUILDER, or of any of its employees or agents orsubcontractors. 6. Responsibility of BUYER: The BUYER shall undertake and assure that the Representativeshall carry out his duties hereunder in accordance with the normalshipbuilding practice of the BUILDER and in such a way as to avoidany unnecessary increase in building cost, delay in the construction ofthe VESSEL, and/or any disturbance in the construction schedule ofthe BUILDER.
